Terms of Service

1. Eligibility

You must be at least 16 years old and able to form a binding contract to use the Service. By using the Service you represent that you meet these requirements. If you are using the Service on behalf of a business, you represent that you have authority to bind that business.

2. Your account and conduct

You are responsible for your use of the Service and for any content you upload or generate. You agree to provide accurate information where requested (for example, a contact email when you create a lead) and to keep your access credentials secure if you ever receive them. You are responsible for ensuring you have the rights to any product image you upload.

3. Acceptable Use Policy

ShotKit is a product-photography tool for merchants and brands. To protect users, downstream platforms, and the Service itself, the following uses are strictly prohibited. This list is illustrative, not exhaustive; we may update it as risks evolve.

• NSFW and sexually explicit content is prohibited. You may not use the Service to generate, attempt to generate, or facilitate nudity, sexual explicitness, pornography, or any sexually suggestive imagery, including any attempt to bypass this rule via rephrased prompts, image uploads, or scene descriptions. This prohibition applies regardless of whether the subjects are real, AI-generated, or depicted as fictional characters.
• Minors. You may not generate images of identifiable real minors, or any content that sexualizes, endangers, or otherwise harms minors.
• Non-consensual sexual or intimate content. You may not generate intimate or sexualized images of real people without their consent, including celebrity or non-celebrity subjects.
• Hate, harassment, and violence. No content that promotes hate, discrimination, harassment, threats, self-harm, or violence against any person or group.
• Illegal goods and activities. No depictions intended to market illegal drugs, weapons, counterfeit goods, or any unlawful activity.
• Deception and fraud. No content intended to impersonate real people, forge documents, mislead consumers, or facilitate fraud.
• Infringement. No content that infringes another party’s trademark, copyright, or other intellectual-property rights.
• Abuse of the Service. No scraping, reverse-engineering, automated high-volume access outside the entitlements you purchased, or attempts to disrupt or circumvent limits, moderation, or billing.

Automated enforcement. Prompt-based generation requests are screened through Creem’s Content Moderation API before any image is generated. Prompts flagged as prohibited are rejected and never sent to the model. We may also suspend or terminate access for violations, at our sole discretion, with no refund for credits or subscription time forfeited as a result of a violation.

4. Paid plans, credits, and refunds

Paid plans — credit packs and the Pro subscription — are billed through Creem, our merchant-of-record. Credit packs are one-time purchases and do not expire. Pro is a recurring monthly subscription that you may cancel at any time; you keep access through the end of the period you paid for. Pricing is listed on the Pricing page and is the single source of truth for both the human-readable copy and the structured data we publish.

If a paid render fails and no image is produced, the consumed credit is automatically refunded to your balance so you are not charged for a render you never received. Beyond that, all sales are final except where required by law. To request an exception, contact help@shotkitapp.com.

5. Licenses and output

Output from paid plans carries a commercial license: you may use the rendered images in product listings, advertising, A+ content, and marketing collateral with no per-image fee and no attribution. Output from the free tier is provided for personal use and listing previews. You retain responsibility for how you use generated output, including ensuring it complies with the policies of any marketplace or platform where you publish it.

6. Service availability

We strive to keep the Service available but do not guarantee uninterrupted or error-free operation. The Service depends on upstream model providers and infrastructure; availability, speed, and output quality may vary. We may modify, suspend, or discontinue features at any time without liability beyond what is stated in these Terms.

7. Disclaimers

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that generated output will be accurate, usable for a particular purpose, or free of defects.

8. Limitation of liability

To the fullest extent permitted by law, ShotKit and its providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, business, or profits, arising out of or related to your use of the Service — even if advised of the possibility of such damages. Our aggregate liability for any claim is limited to the amount you paid us in the three months preceding the claim.

9. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, including the Acceptable Use Policy, or if your conduct creates risk for us, other users, or third parties. Upon termination for cause, credits and subscription time may be forfeited without refund.

10. Changes to these Terms

We may revise these Terms from time to time. The “Last updated” date above indicates the latest version. Material changes will be reflected here; by continuing to use the Service after a change takes effect, you agree to the revised Terms.
